CARTER DATED AUGUST 21, 2008 AND RECORDED IN BOOK 889 AT PAGE 91 IN THE ANSON COUNTY PUBLIC REGISTRY, NORTH CAROLINA NOTICE OF SALE Under and by virtue of the power and authority contained in the above-referenced deed of trust and because of default in the payment of the secured indebtedness and failure to perform the stipulation and agreements therein contained and, pursuant to demand of the owner holder of the secured debt, the undersigned substitute trustee will expose for sale at public auction to the highest bidder for cash at the usual place of sale at the county courthouse of said county at 2:30PM on June 11, 2014 the following described real estate and any improvements which may be situated thereon, in Anson County, North Carolina and being more particularly described as follows: Lying and being located in Lilesville Township, Anson County, and more particularly described as follows: BEGINNING at an axle hub, the northwest corner of Lot No. 10 of Sunnyside and northeast corner of Lot No. 7 of Meadowview located at N.C. Geodetic Grid coordinates N. 445854.56 E. 1695747.15, a control corner for Meadowview, and from said control corner runs S. 19-39-40 W. 450.55 feet along the division line between Sunnyside and Meadowview to a stake, a common corner of Lots Nos. 8 &9 of Meadowview in said line, the point of beginning of the lot herein conveyed, and from said point of beginning runs S. 19-39-40 W. 153.05 feet along said division line to a stake in the edge of Meadowview Drive, the southeast corner of Lot No. 9 located at a perpendicular distance of 30 feet from the center of said drive; thence N. 86-50 W. 48 feet along the edge of said drive to a stake, the southwest corner of Lot No. 9 located at a perpendicular distance of 30 feet from the center of Meadowview Drive, thence N. 20-46-30 W. 217.15 feet along the edge of said Drive to another stake, a common corner of Lots Nos. 8 & 9 located at a perpendicular distance of 30 feet from the center of said drive; thence S. 70-28 E. 183.4 feet along and with the division line between Lots Nos. 8 & 9 to a point of beginning, and being all of Lot No. 9 of Meadowview according to and shown by that certain plat, plan and survey made by William G. Martin, R.L.S., under date of July 2, 1974 and reference is hereby made and had to the aforesaid plat and survey and the description therein and thereon appearing of the lot herein conveyed is by reference made a part of the description of this instrument to the same extent as though set out herein verbatim. And being more commonly known as: 62 Meadowview Dr, Wadesboro, NC 28170 The record owner(s) of the property, as reflected on the records of the Register of Deeds, is/are Bertha A. Carter. The property to be offered pursuant to this notice is being offered for sale, transfer and conveyance "AS IS, WHERE IS." Neither the Trustee nor the holder of the note secured by the deed of trust, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments including but not limited to any transfer tax associated with the foreclosure.
